We care about protecting the personal information of our Client or User (as defined under the Terms of Use) who use our website https://www.k9school.in/  (“Platform”) and, our Services (as defined below). Please read the Privacy and Cookie Policy carefully prior to using or registering on the Platform or accessing any material, information or availing any Services (as defined below) through the Platform.

Jorick Ultra Luxury Life Pvt. Ltd (hereinafter referred to as “Company”), a private limited company incorporated under the Companies Act, 2013, and having its registered office at First Floor, Flat No. F7-12, Block F1, DDA Flats, Vasant Kunj, New Delhi, South Delhi, Delhi – 110023, India (hereinafter referred to as “K9 School”) offers a suite of canine-related Boarding Services, including Behavioral Consultation, Board and Train programs Services, Dog Walking,  Services and Personalized home training Services,  certification courses for canine professionals (including for trainers, handlers, walkers, etc.), trained working dogs for security and protection  and Ancillary Services (which may include but not limited to, third party pick-up and drop-off of Dog(s) to and from the Client’s home or designated location, Pick-up and Drop off to Groomers and Veterinary, any Medical Administration if required, Veterinary Consultations along with Bath and Grooming (without fur trimming) Services) or any combination thereof availed by the Client of the Company (hereinafter referred to as “Services”) as a Service to its User, conducive to them by furnishing reinforcement via efficacious response and streamlined internal processes.

This policy (“Privacy Policy”) read together with the Terms of Use sets out the manner in which K9 School uses, shares, maintains, discloses and protects any personal data and information from User (each, a “Users”, “You” or “Your” or “Member”) that:

  1. You provide when you use this website https://www.k9school.in/ ;
  2. You provide as a User, business contact, or as someone contacting us for any business-related reasons; and

This policy extends to the Platform and all the Services offered by K9 School. Herein, “We”, “Us” and “Our” refer to K9 School and K9 School Corporate family. It provides the purpose for which We collect personal data, how We use it, and what are Your legal rights in respect to the personal data We hold.

By clicking on the “I agree” button or using, registering or signing up for the Service, You (“You” or “Your” as applicable) accept and undertake to be obliged by the terms and conditions of this Privacy Policy and agree to be contacted by K9 School to inform You about our Services and/or upcoming benefits offered by Us or any of our affiliates or any other sub-domains. This Privacy Policy is incorporated into and subject to Our Terms of Use (hereinafter referred to as the “Terms”) and shall be read harmoniously and in conjunction with the Terms. All capitalized terms used and not defined in this Privacy Policy shall have the meaning ascribed to them under the Terms.

If You are undernote yet 18 years of age-old or otherwise lack the legal capacity authority to enter into form legally binding contracts under applicable law (including without parental or guardian consent) (or permission from your parents or legal guardians), we forbid You are not permitted to use this Platform or K9 School’s services. We do not knowingly solicit or knowingly collect any information from individuals visitors  under 18 years of age. If You are a minor and choose to You voluntarily non-comply access the Platform or submit personal information with the permission of your parents (or legal guardian), it will be deemed as Your acceptance of this policy.

This Privacy Policy is an electronic record in terms of the Information Technology Act, 2000 (as amended/re-enacted from time to time) hereinafter referred to as “IT Act” and rules thereunder, and, amongst others, is published in accordance with the provisions of the Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, which mandates for publishing of rules and regulations, privacy policy and terms of use for access or usage of the Service This policy is an electronic record, generated by a computer system and does not require any physical or digital signatures. 

  1. Modifications to the Privacy Policy:

Any information received by us shall be treated in accordance with the applicable laws and regulations of India. It shall be duly noted, that, this policy is subject to amendment/s based on any business, legal or regulatory requirements and thereupon shall be updated online owing to which We encourage You to review the policy time and the changes made. We shall make all efforts needed to communicate any significant changes in regard to this policy to You. The User’s continued avail of the Services even after any modifications to this policy will be deemed as Your acceptance of such modification.

We simply collect the personal information You disclose or provide to Us.

2.1    Collection of Personal Information

2.1.1 About Client or User 

Here, the term “Personal Information of the Client or User” encompasses any data that can be employed to identify and distinguish an individual. This includes but is not confined to, a person’s first and last name, residential or other physical and virtual addresses, age, and gender, such as an email address, contact details, incoming/outgoing messages, business information, products and services You are interested in or require more information about that We might need. Additionally, if any sensitive personal information is in concern, it shall carry the meaning as may be defined under applicable laws from time to time. Further, all such information that You provide to Us must be true, complete and accurate and You must notify Us of any changes to such personal information.

2.1.2 About Dog

Here, the term Dog can be defined as the canine animals owned by the Client and submitted for availing Services and henceforth “Personal Information of the Dog” also includes details about Your Dog which include but are not confined to, the registered name of the Dog, the owner’s address, age and gender, physical characteristics, veterinary requirements, particular dietary needs, any ailments, if applicable prescribed off lead or other special compulsions. 

2.2  Information collected Automatically   

Some Information is automatically collected – such as Your Internet Protocol (IP) address and/or browser and device characteristics when You visit or navigate Our website. This does not reveal Your specific identity (like name or contact information) but may include device and usage information, such as Your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when You use our website and other technical information. This is primarily needed to maintain the security and operation of our website and for our internal analytics and reposting purposes.

2.3 Collection of Personal Information from Social Networking Sites

You may log into Our Platform through Your Facebook account. If You do so, You must enter the email address and password that You use for Your Facebook account. We will ask that You grant Us permission to access and collect Your Facebook basic information (this includes Your name, profile picture, gender, networks, user IDs, list of friends, date of birth, email address, and any other information You have set to public on your Facebook account). If You allow Us to have access to this information, then We will have access to this information even if You have chosen not to make that information public.

We store the information that We receive from Facebook with other information that We collect from You or receive about You.

Facebook controls the information it collects from You. For information about how Facebook may use and disclose your information, including any information you make public, please consult Facebook’s privacy policy. We have no control over how any third-party site uses or discloses the personal information it collects about You.

2.4 You provide Us with Your Personal Information when You:

  1. Register or log in to Your Account on Our Platform
  2. Start, sign or review a Listing (as described under the “Terms of Use”)
  3. Create or edit Your User profile
  4. Contact customer support
  5. Leave any Submitted Content (as described under the “Terms of Use”) on Our community forums
  6. Participate in surveys, sponsored events, sweepstakes or when you sign up for newsletters.

2.5 You also provide Us with Personal Information about others, when You:

  1. Start or participate in a booking a Service  
  2. Share information with K9 School’s service providers
  3. Add others as members to an existing Account
  4. Leave comments
  5. Refer friends

2.6 Like many businesses, we collect information through cookies and similar technologies. 

2.7  We may also collect Personal Information about You from others, such as:

  1. Third-party Sources – Like marketers, partners, researchers, affiliates, service providers and others where they are legally allowed to share Your Personal Information with Us.
  2. Other Users – Other Users may give Us Your Personal Information.
  3. Combining Personal Information from different sources –  Under some circumstances, We may combine the Personal Information We receive from other sources with Personal Information We collect from You (or Your Device).  

2.8 Additional Profile Information such as gender, preferred language, city, and personal description. 

2.9 Biometric Information

Such as facial recognition data derived from photos and identification documents You submit for verification, where offered with Your consent where required under applicable law.

2.10 Cookies and similar technologies as described in Our Cookie Policy

Payment Transaction Information such as payment instrument used, date and time, payment amount, payment instrument expiration date and billing Pincode, Email address (used for payment), Your address and other related transaction details.

  1. Your Full Name and Use of K9 School’s Information

3.1 Your Full Name 

As a Registered User of the Platform, You will select a Full Name during the registration process. All of Your activities on the Platform will be traceable to Your Full Name. Certain other people, including other Registered Users with whom You have transacted business via the Platform, can see a large part of Your activity on the Platform. If You book a Service with a Registered User, cancel a scheduled Service with a Registered User or received a Service (as defined under the Terms of Use), K9 School may send a notice to You or the appropriate registered User that includes Your Full Name. Thus, if You associate Your real name with Your Full Name, the people to whom You have revealed Your name may be able to personally identify Your Platform activities.

3.2 Using Information from K9 School

The Platform facilitates Your sharing of personal information with others in order to negotiate, provide, and use the Services. If You agree to contract for a service with another registered User, You may need to reveal Your name, email, phone number, or personal address to that individual so that the Service may be performed. Please respect the privacy of others. You agree to use the information of other users solely for the following purposes: (a) K9 School-transaction-related purposes; and (b) using Services offered through the Platform.

3.3 Account Protection

Your password is the key to Your Account. When creating Your password You should use unique numbers, letters, special characters, and combinations thereof. In addition, DO NOT disclose Your password to anyone. If You do share Your password or Your personal information with others, You are solely responsible for all actions taken via Your Account. If You lose control of Your password, You may lose substantial control over Your Personal Information and be subject to legally binding actions taken on Your behalf. Thus, IF YOUR PASSWORD HAS BEEN COMPROMISED FOR ANY REASON, YOU MUST IMMEDIATELY NOTIFY K9 School TO CHANGE YOUR PASSWORD.

4.1.    Device Data: Data about Your computer, phone, tablet, or other device You use to access the website. The following information about Your device may be collected:-

5.2.    We process such information for legitimate business interests, fulfilment of Our contract with You, compliance with the associated legal obligation and/or Your consent.

  • Provide You with and collect payment for the Services You requested.
  • Enable You to access the Platform and make and receive payments

  • Develop and improve our services 
  • Provide customer service training
  • Process, handle or assess insurance claims or similar claims
  • Enable Your use of Dog-care related Services
  • To enable User-tourer communication
  • To manage User accounts and keep work in order   
  • To send administrative information to You like new feature information or any changes in terms, conditions and policies
  • To protect Our services for example from fraud monitoring and prevention.
  • To enforce Our terms, conditions and policies for business purposes to comply with any legal, regulatory or contract requirements
  • To respond to legal requests and prevent harm
  • Fulfil and manage your Bookings
  • Administer prize draws and competitions
  • To deliver or facilitate delivery services to the User
  • Maintain and improve the security of the Services
  • To respond to user inquiries or offer support
  • To send you marketing and promotional communications.
  • To deliver targeted advertising to you
  • For other business purposes such as data analysis, determining the effectiveness of promotional campaigns, evaluating and improving our website, and identifying usage trends. 

5.3.2 Safeguard the Platform and Community

  • Detect, prevent, assess and address fraud and security risks
  • Verify or authenticate information provided by You, including identity information, as described In the Information we collect.
  • Conduct checks against databases and other information sources, including background checks.
  • Comply with our legal obligations, and protect the health and well-being of our Users and Dogs..
  • Enforce Our agreements with third parties
  • Determine eligibility for certain types of Services.
  • Comply with law, respond to legal requests, prevent harm and protect Our rights.
  • Enforce our Terms and other policies, if any.
  • Assess or evaluate Your interactions with the Platform and information obtained from third parties.

5.3.3 Analyze and Share Your Communications

We may review, scan or analyze Your communications on the Platform for reasons outlined in Clause 5 (Why do we collect Your information) section of this Policy, including fraud prevention, security investigations, risk assessment, regulatory compliance, product development, research, analytics, enforcing our Terms of Use and customer support purposes. 

We use automated methods where reasonably possible. Occasionally we may need to manually review communications, such as for fraud investigations and customer support, or to assess and improve the functionality of these automated tools. We will not review, scan or analyze your messaging communications to send third-party marketing messages to You and we will not sell reviews or analyses of these communications. We may also share Your communications as set out in Clause 6 of this policy. 

5.3.4 Provide Payment Services

Personal Information is used to enable or authorize third parties to use, Payment Services such as to:

  • Detect and prevent money laundering, fraud, abuse and security incidents, as well as conduct risk assessments,
  • Comply with legal and compliance obligations, such as anti-money laundering regulations and sanctions enforcement
  • Enforce “Payment Terms” and other payment policies
  • Provide and improve Payment Services.

5.4.     We may use and store this information in aggregated and anonymized form so that it is not associated with a particular User. We will not use identifiable personal information without Your consent.     

5.5 We collect demographic information because we have a legitimate interest in ensuring that Our Services are legal based on the location (Jurisdiction) – such as appropriate, (i) support; (ii) Dog requirements; and (iii) templates. It is hereby noted that IP information will not be used for behavioral purposes absent explicit consent.

  1. Will your Information be shared with anyone?

6.1     You also specifically agree and consent to Us collecting, storing, processing, transferring, and sharing information (including Personal Information) related to You with third parties such as entities registered under applicable laws solely for providing Services to You including processing Your Transactions on the Platform. Provided that, the third-party entities shall be bound by contractual obligations to keep such information confidential and use it only for the purposes for which We disclose it to them. 

6.2     We may process or share the data we hold based on the following legal basis:

  1. Consent: Given specific consent for use in a specific purpose
  2. Reasonable to achieve necessary legitimate business interests.   
  3. For the performance of a Contract and fulfilling the terms thereunder.
  4. Where vital interests are involved necessary to investigate, prevent or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities or as evidence in litigation in which we are involved. 

6.3.  More specifically, You hereby consent that Your data or personal information may be processed under the following scenarios:

  1. Business transfers: In connection with or during negotiations of any merger, sale of a company, assets, financing or acquisitions of all or a portion of our business to another company.
  1. Vendors, Consultants and Other Third-Party Service Providers: The people who perform services for us or on our behalf and require access to such information to do that work. For example, payment processing, data analysis, email delivery, hosting services, customer service and marketing efforts. Unless described, we do not share, sell, rent or trade any of your information with third parties for their promotional purposes.
  1. Affiliates: This includes our parent company, any subsidiaries, joint venture partners or other companies that we control or that are under common control with us. If we share such information, then in that case, we will require them to honour this policy.
  1. Business Partners: We may share your information with our business partners to offer you customized products, services or promotions. 
  1. Public or Government Authorities: We may disclose Your Personal Information to comply with Our legal obligations, regulations, contracts or while responding to a court order, administrative or judicial process where we are legally compelled.

Other users: When you share personal information (for example, by posting comments, contributions or other content to the website or interacting in public areas of the website) such information may be viewed by all users and may be publicly made available outside the website in perpetuity. Similarly, other users will be able to view descriptions of your activity, communicate with you within our website and view your profile.

6.4 Members Service Providers

The Service Providers may use third-party services to manage or deliver their services, such as providing Ancillary Services to Your Dog. Thereupon, the Company may use features on the Platform to share Your information with such third party service provider. Other members may use Services other than K9 School to process Your data, including email or reservation management software. Such services are outside of K9 School’s control and will be subject to applicable law. 

6.5 Service Providers

We share Personal Information with affiliated and unaffiliated Service Providers (including their service providers) to help us run our business and for their compliance purposes, including those who help us:

  1. Verify Your identity or authenticate Your identification documents;
  1. Check the information against public databases;
  2. Conduct background checks, fraud prevention, security investigations and risk assessments;
  3. Perform product development, maintenance and debugging;
  4. Allow the provision of the K9 School Services through third-party platforms and software tools;
  5. Provide customer service, advertising or payment services;
  6. Offer additional services 
  7. Process, handle or assess insurance or similar claims;
  8. Review, scan and analyze communications on the Platform for certain purposes, such as evidence of child exploitation;
  9. Offer flexible payment and financing provided by a third-party credit provider;

These providers are contractually bound to protect Your Personal Information, have access to Your Personal Information to perform these tasks, and may also disclose Your information where required by law.

7.1 Build Your Public Profile

Information You share publicly on the Platform may be indexed through third-party search engines. In some cases, You may opt out of this sharing in Your Account settings. We may make certain information publicly visible to others, such as:

  2. Content in a community or discussion forum, blog or social media post, and content You make available to the public, including Listing details on third-party sites, platforms and apps.

7.2 Comply with Law, Respond to Legal Requests, Prevent Harm, and Protect our Rights

7.2.1 Disclosure

We may disclose Your information to courts, law enforcement, governmental or public authorities, tax authorities, authorized third parties or other Members, if and to the extent we are required or permitted to do so by law or where disclosure is reasonably necessary to:

  1. Comply with Our legal obligations;
  1. Comply with a valid legal request;
  2. Respond to a valid legal request relating to a criminal investigation to address alleged or suspected illegal activity or to respond to or address any other activity that may expose Us, You or any other of our Users to legal or regulatory liability;
  3. Enforce and administer our agreements including Terms and Polices;
  4. Respond to requests for or in connection with current or prospective legal claims or legal proceedings concerning K9 School and/or third parties, in accordance with applicable law;
  5. Protect the rights, property or personal safety of K9 School, its employees, its members or members of the public

7.2.2 To Tax Authorities

Where legally required or permissible according to applicable law, We may disclose User information to relevant tax authorities or other governmental agencies, depending on where You are based, for the purpose of the tax authorities’ determination of proper compliance with relevant tax obligations.

7.2.3 To Governmental Authorities for Registrations, Notifications, Permits or License Applications or Numbers

In a jurisdiction where K9 School facilities or requires a registration, notification, permit or license application or number of a Service Provider with a governmental authority, We may share information of participating Service Providers with the relevant authority, during the application process, when the Listing is published, and periodically thereafter. 

7.3 Notification

Where appropriate and/or legally required, we may notify members about legal requests, unless:

  1. Providing notice is prohibited by the legal process itself, by court order We receive or by applicable law; or
  1. We believe that providing notice would be futile, ineffective, create a risk of injury or bodily harm to an individual or group, or create or increase a risk of fraud upon or harm to K9 School, Our members, or expose K9 School to a claim of obstruction of justice.

7.4 Effectuate Business Transfer

If K9 School undertakes or is involved in any merger, acquisition, reorganization, sale of assets, bankruptcy, or insolvency event, then We may sell, transfer or share some or all of Our assets, including Your information in connection with such transaction or in contemplation of such transaction, such as due diligence. In this event, We will notify You before Your Personal Information is transferred and becomes subject to a different Privacy Policy. 

  1. Who will Your information be shared with and the retention mechanism to be followed?

8.1.      We only share and disclose Your information with the following third parties. If We have processed Your data based on Your consent and You wish to revoke it, please contact Us using the contact details provided in the section below titled “Your Consent and Changes to Privacy Policy”. We will delete information based on a request received from You within a reasonable period and latest within 90 (ninety) days of receiving a deletion request. However, We may retain such portion of information for such periods as may be required under applicable law. 

Notwithstanding anything contained herein, We may retain data after account deletion for reasons including but limited to the following purposes: 

  1. if there is an unresolved issue relating to Your Account, or an unresolved claim or dispute; 
  2. if We are required to by applicable law; and/or in aggregated and/or anonymized form; or
  3. We may also retain certain information if necessary for its legitimate business interests, such as fraud prevention and enhancing the safety and security of individuals using the Platform.

8.2.    When there is no ongoing legitimate business need to retain such data, we will either delete or anonymize such information, or, if this is not possible (for example, if stored in backup archives), then we will securely store Your personal information and isolate it from any further processing until deletion is possible

8.4.    You hereby grant Us consent to share Your information with third parties, as mentioned hereinabove and We shall in no manner be responsible or be under any obligation to inform You or seek additional consent from You for such sharing of information.

Further, You agree and acknowledge that You shall strictly keep all information of other individuals confidential and shall not disclose such information to any third party unless expressly consented to by the individual whose information is being disclosed. In no circumstance whatsoever will We be responsible or liable for any breach of confidentiality by You or other individuals on the Platform.

  1. Your Consent and changes to the Privacy Policy

9.1  Withdrawal Policy: 

You may choose to withdraw Your consent provided hereunder at any point in time. Such withdrawal of the consent must be sent in writing to info@k9school.in. In case You do not provide Your consent or later withdraw Your consent, We request you not to access the Platform and use the Services. We reserve the right to not provide You with any of the Services on the Platform upon the withdrawal of Your consent. 

In such a scenario, We may delete Your information or de-identify it so that it is anonymous and not attributable to You. In the event that We retain Your information post the withdrawal or cancellation of Your consent, it shall only be for the period permitted under Applicable Law. We may continue to retain Your information if required under Applicable Law. 

9.2.  Correcting inaccuracies in the information: 

You may correct or update any information online. In the event of loss of access details, You may retrieve the same or receive new access details by sending an e-mail to: info@k9school.in.

9.3   Changes To Our Privacy Policy: 

We reserve the unconditional right to change, modify, add, or remove portions of this Privacy Policy at any time, by notifying You of such changes. Any changes or updates will be effective immediately. Your continued usage of the Platform post such changes or updates will serve as your unqualified acceptance of such changes or updates. You should review this Privacy Policy regularly for changes. You can determine if changes have been made by checking the “Last Updated” legend above.

  1.     How do we keep Your information safe – Security Measures?

Your data and information are reasonably protected on Our Platform through a system of organizational and technical security measures from unauthorized third parties, misuse, loss, disclosure, destruction and alteration. 

10.1.    Further, whenever You change or access Your Account on the Platform or any information relating to it, We offer the use of a secure server. We cannot however despite our safeguards and efforts, ensure or warrant the security of any information You transmit to Us or guarantee that Your Personal Information and/or other Non-Personal Information provided for availing the Services or Platform may not be accessed, disclosed, altered, or destroyed by a breach of any of Our security measures and safeguards, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure. It is further clarified that You have, for so long as You access and/or use the Platform (directly or indirectly), the obligation to ensure that You shall at all times take adequate physical, managerial, and technical safeguards, at Your end, to preserve the integrity and security of Your data which shall include and not be limited to Your Personal Information.

10.2.     This Privacy Policy and the security controls and practices implemented by Us to Protect Your Personal Information shall be reasonable security practices and procedures under section 43A of the Information Technology Act, 2000.

    Our Platform may provide links to other third–party Platforms (“Third–Party Sites”) that may collect Your Personal Information including Your IP Address, browser specification, or operating system. We are not in any manner responsible for the security of such information or the privacy practices or content of those Third–Party Sites. Additionally, You may also encounter “cookies” or other similar devices on certain pages of the Third–Party Sites and it is hereby clarified that We do not control the use of cookies by these Third–Party Sites. These third-party service providers and Third-Party Sites may have their own privacy policies governing the storage and retention of Your information that You may be subject to. This Privacy Policy does not govern any information provided to, stored on, or used by these third-party providers and Third-Party Sites. We recommend that when You enter a Third-Party Site, You review the Third-Party Site’s privacy policy as it relates to safeguarding of Your information. You agree and acknowledge that We are not liable for the information published in search results or by any Third-Party Sites.
